CFTC Asks Court to Vacate 2022 Settlement with Gemini, Admitting Lawsuit Invalid

The CFTC has petitioned a federal court in New York to nullify its 2022 settlement with crypto exchange Gemini, acknowledging the lawsuit was unfounded.

The U.S. Commodity Futures Trading Commission (CFTC) filed a motion with the U.S. District Court for the Southern District of New York seeking to vacate a 2022 settlement agreement with cryptocurrency exchange Gemini. The regulator has conceded that the underlying lawsuit was without merit.

This development marks a reversal in the CFTC's enforcement action against Gemini, which originally resulted in a settlement over alleged violations. The court will now decide whether to grant the CFTC's request to annul the deal.
